COMPREHENSIVE PRIVACY NOTICE

Mauricio Martínez Langarica (hereinafter, 'GenIA Labs'), operating as an Individual with Business Activity, with address at Uxmal 513 Int. 3, Vértiz Narvarte, Benito Juárez, 03600 Mexico City, CDMX, is responsible for the processing and protection of your personal data.

To carry out the purposes described, we will use: a) Identification and contact data (Name, company name, email). b) Billing data (RFC, regime and tax address). c) Access data (Third-party users and passwords, treated under strictly contract for technical execution).

Personal data will be used for the following necessary purposes for the requested service:

Your personal data will be kept for a period of 5 (five) years, in accordance with the Federal Tax Code, to guarantee the legal security of the projects. Subsequently they will be eliminated or anonymized.

GenIA Labs implements strict technical and administrative measures. Access data are not stored in public bases and are restricted exclusively to the personnel necessary for execution.

The processing of your identification and contact data is carried out under implied consent in accordance with article 8 of the LFPDPPP, inferred from the relationship you establish with GenIA Labs (for example, by submitting the contact form). Your financial or asset-related data (RFC, tax regime and tax address) is processed under the exception set out in article 10, section III of the LFPDPPP, as it is necessary for the fulfillment of the legal relationship that you expressly accept through the Terms and Conditions acceptance checkbox when hiring the service, whose version and date are logged as evidence of such acceptance.

GenIA Labs will not carry out transfers of personal data to third parties outside the provision of the service, except for legal exceptions provided for in article 37 of the LFPDPPP or requirement of competent authority. This is independent of the processing carried out by our data processors described in Section 8, who may be located inside or outside Mexican territory.

To provide our services, GenIA Labs shares the strictly necessary data with the following data processors, who act on behalf of and under the instructions of GenIA Labs in accordance with article 36 of the LFPDPPP, subject to confidentiality and information security obligations: Supabase (storage of contact form data), Resend (sending email notifications), Vercel (website hosting and technical records), Google LLC through Google Tag Manager/Analytics (site analytics, enabled only with your consent) and Stripe (processing payments for subscriptions to our SaaS products). These processors may store and process your information on servers located outside Mexico; in such cases, GenIA Labs contractually requires each processor to maintain confidentiality and information security measures consistent with the LFPDPPP. This engagement relationship does not constitute a transfer of data to third parties under the terms of Section 7.

Should a security breach occur at any stage of processing that significantly affects your property or moral rights, we will inform you immediately via servicio_cliente@genialabs.ai, in accordance with article 20 of the LFPDPPP, stating the nature of the incident, the data involved and the corrective measures taken.

You have the right to Access, Rectify, Cancel or Oppose (ARCO) the processing of your personal data in accordance with articles 28-34 of the LFPDPPP.

To exercise your ARCO rights, send your request to: servicio_cliente@genialabs.ai or to the form at https://www.genialabs.ai/en/contacto. You can also write to our address: Uxmal 513 Int. 3, Vértiz Narvarte, Benito Juárez, 03600 Mexico City, CDMX. Your request must include: full name, contact information, description of the right to exercise and documents proving your identity. We will respond within a maximum period of 20 business days in accordance with article 32 of the LFPDPPP.

You can revoke the consent granted for the processing of your personal data at any time, provided there is no legal impediment. To revoke, send a request to servicio_cliente@genialabs.ai indicating the data with respect to which you revoke consent. The revocation will take effect upon confirmation by us, within a maximum period of 20 business days.

You may limit the use or disclosure of your personal data by sending a request to servicio_cliente@genialabs.ai. If you do not want your data used for secondary purposes (newsletters, promotions, analytics), indicate this expressly. We maintain an internal log of limitation requests under article 27 section V of the LFPDPPP.

GenIA Labs does not collect sensitive personal data (racial or ethnic origin, health status, religious beliefs, political opinions, sexual preference, etc.) on a regular basis. If it is necessary to process them in any specific service, express written consent will be requested in accordance with article 9 of the LFPDPPP, independently of general consent.

Our services and website are directed at adults and businesses; we do not intentionally collect personal data from minors. If we discover that a minor's data was collected without the verifiable consent of a parent or legal guardian, we will delete it unless such consent can be evidenced in accordance with the law.

We use cookies and Google Analytics to improve the site experience. Details of each cookie, its purpose, duration and how to grant or withdraw consent are available in our Cookie Policy (https://www.genialabs.ai/en/cookies). You can disable them from your browser or from the consent banner, although this could affect the functionality of certain services.
